A judge has withdrawn from a case launched by an activist questioning Mombasa Governor Hassan Ali Joho’s degree from Kampala University in Uganda.
The reason for Justice Mary Kasango’s withdrawal is not known and lawyers for both parties only learnt of his recusal when they turned up for the mention of the case launched by Meke Otuke.
Yesterday she was to give direction on the application by Joho to strike out the case. The lawyers were surprised to learn that the file of the case was with Justice Edward Mureithi who told them that he was now handling the matter after being directed to do so by Justice Kasango.
Parties to the matter disclosed that Justice Kasango did not inform them of her withdrawal from the case beforehand. “My Lords, I was not aware that the judge has disqualified herself from this case,” Otuke’s lawyer Gikandi Ngibuini told Justice Mureithi.
